1. Quotes and Acceptance

1.1 Where possible, work is carried out on the basis of a fixed price quote provided prior to commencement. Where a fixed price quote is not provided (including for some after-hours or emergency work), the job will instead be charged on a time and materials basis, and the client will be advised that this is how the job is being billed before work begins or as soon as reasonably practicable once this becomes clear.

1.2 Acceptance of a quote, or of a time and materials basis of charging, (verbally, in writing, or by proceeding with the work) constitutes acceptance of these Terms and Conditions.

1.3 Where a fixed price quote is provided, it is based on a visual inspection and the information available at the time, and assumes existing plumbing complies with relevant laws, regulations, and Australian Standards, and that the site is reasonably accessible during normal working hours.

1.4 Fixed price quotes are valid for 30 days from the date issued. If a quote is not accepted within that time, Taylor'd Plumbing Services may need to review and reissue the price.

1.5 Work requested outside standard business hours will generally be provided as a fixed job price reflecting after-hours attendance, assessed on a case-by-case basis; where this is not practicable, it will be charged on a time and materials basis as set out in clause 1.1.

2. Variations and Unforeseen Conditions

2.1 Any of the following, if encountered once work has commenced, will be treated as a variation and may result in additional charges, communicated to the client as soon as practicable before proceeding:

  • hidden pipe damage or non-compliant existing plumbing;

  • excess soil, rock, or reef material requiring excavation and removal;

  • suspected asbestos-containing material, including any costs of identification or safe removal;

  • tree root intrusion or blockages requiring special treatment, drain inspection equipment, or pipe replacement (note: clearing a blockage alone does not guarantee the issue won't recur unless permanent repairs are carried out); and

  • restricted access to the site.

2.2 Any change to the agreed scope of work must be approved by the client before proceeding.

2.3 Excavation and digging work carries the risk of encountering unmarked or unmapped underground pipes, cables, or services. Taylor'd Plumbing Services will take reasonable care and use available information to identify these in advance, but does not warrant that all such services will be located, and is not liable for damage to unmarked or undisclosed services encountered during excavation.

3. Payment Terms

3.1 Invoices are issued on completion of work and are payable within 7 days of the invoice date, unless otherwise agreed in writing (e.g. 14-day terms for approved accounts).

3.2 Payment can be made via the methods listed on the invoice. A surcharge applies to payments made by credit or debit card, to cover the cost of card processing, and will be shown on the invoice or payment request at the time of payment.

3.3 Late payment may incur interest at the rate prescribed under the Penalty Interest Rates Act 1983 (Vic), and the client is responsible for any reasonable costs incurred in recovering overdue payment.

3.4 If an invoice remains unpaid, Taylor'd Plumbing Services may suspend further work until the account is brought up to date, and may terminate the job if payment is not made within 7 days of that suspension, without affecting its right to recover payment for work already completed.

4. Cancellations and Callout Fees

4.1 A minimum of 24 hours' notice is required to cancel or reschedule a booked appointment.

4.2 Cancellations made with less than 24 hours' notice, or a failure to provide access at the agreed time, may incur a callout fee to cover time and travel already committed.

4.3 If a technician attends site and is unable to carry out the work due to client unavailability, incorrect access, or unsafe site conditions, a callout fee will apply.

5. Retention of Title

5.1 Ownership of any materials, parts, or goods supplied remains with Taylor'd Plumbing Services until payment has been received in full, including for any variations or extra work.

5.2 If payment is not made, Taylor'd Plumbing Services reserves the right to recover any unpaid materials or goods, where reasonably possible.

5.3 Any materials or fixtures removed from site during the works remain the property of Taylor'd Plumbing Services unless otherwise agreed with the client in writing.

6. Defects and Warranty

6.1 Taylor'd Plumbing Services stands behind the quality of its workmanship on every job.

6.2 For regulated plumbing work valued over $750 requiring a compliance certificate, the work is backed by the Victorian Plumbing Fund, which provides insurance cover for defective work for six years from the date the compliance certificate is issued, in accordance with Victorian law.

6.3 This cover applies to defects arising from workmanship only. It does not cover damage caused by misuse, normal wear and tear, pre-existing conditions, work carried out by others after completion, or failure of parts or fixtures not supplied by Taylor'd Plumbing Services (which remain subject to the manufacturer's own warranty).

6.4 Clients must notify Taylor'd Plumbing Services in writing of any defect to arrange inspection and rectification, and, where applicable, may also refer eligible claims to the Plumbing Fund.

7. Insurance

7.1 Taylor'd Plumbing Services holds the statutory insurances required of a licensed plumbing contractor in Victoria.

7.2 The client is responsible for their own home and contents insurance covering the property and its contents during the course of the works.

8. Limitation of Liability

8.1 To the extent permitted by law, Taylor'd Plumbing Services is not liable for any indirect, consequential, or economic loss arising from the work performed, including but not limited to loss of income, loss of use, or damage to property not directly caused by the work carried out.

8.2 Taylor'd Plumbing Services is not liable for any delay or failure to complete work caused by circumstances beyond its reasonable control (e.g. extreme weather, supplier delays, government restrictions).

8.3 Nothing in these terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law that cannot lawfully be excluded.

8.4 Where permitted by law, liability for any breach of a non-excludable guarantee is limited, at Taylor'd Plumbing Services' option, to the resupply of the services or the cost of having the services resupplied.

9. Access and Client-Supplied Materials

9.1 The client is responsible for providing safe and reasonable access to the work area, including any scaffolding or access equipment not otherwise arranged by Taylor'd Plumbing Services.

9.2 Where the client supplies their own fixtures, fittings, or materials, these are stored, handled, and installed at the client's risk, and Taylor'd Plumbing Services is not liable for any defect or unsuitability in client-supplied items.

10. Dispute Resolution

10.1 If a client is dissatisfied with any aspect of the work, they should notify Taylor'd Plumbing Services in writing, setting out the details of the concern.

10.2 Taylor'd Plumbing Services will respond within 7 days with a proposed way to resolve the issue.

10.3 If the matter cannot be resolved directly, either party may refer the dispute to Consumer Affairs Victoria, the Victorian Building and Plumbing Commission, or another appropriate body for assistance.

11. Governing Law

11.1 These terms are governed by the laws of Victoria, Australia.

11.2 If any provision of these terms is found unenforceable, the remainder will continue to apply.
